Within the world of negotiations of real estate, there comes a familiar phrase sold as is. This may appear in the initial Listing when it hits the mkt or may be used in negotiations when an offer is presented to allow both sides to be aware that upon inspections, the seller will not credit or fix(cost out of sellers pocket) anything because of this agreement.
I have to say though, in my experience, this sold as is application, sometimes doesn’t carry the weight that it implies. I have been on both sides, buy & sell, and have seen it reverse it’s implications thru the deal. Case in point, thru an inspection something is brought to the buyers attention in the home inspection that the buyer or buyer’s agent didn’t see or weren’t aware of when viewing the home and placing offer.
The Buyers agent then asks the seller for a non sold as is, request, thus throwing the understanding out the window, per say. Even though I’m conveying that it may not be fully implemented, it is still a good tool, in my opinion, in negotiations of an existing offer as it does limit the buyers requests at time of inspection.
